The US Commerce Department has delayed its preliminary ruling on Chinese rubber chemical imports after a request from Lanxess, permitting extra time to inspect subsidy programs. The outcome could reshape trade in specialty chemicals and effect US producers.

The probe emerged from a petition filed by Lanxess Corporation, a main specialty chemicals maker with a considerable footprint in the US and worldwide rubber markets. The petition claimed that Chinese exporters advantage from state subsidies, doubtlessly giving them an unfair price benefit in the US market.

The move was not isolated; along the countervailing duty investigation, a parallel anti-dumping action was started focusing the same product from China. Both cases shows wider concerns amongst US producers about the effect of subsidized and probably underpriced imports on domestic industry viability.

Lanxess requests more time for comprehensive review

On July 8, the International Trade Administration (ITA), a branch of the US Department of Commerce, declared an extension to the timeline for its preliminary findings. As per the ITA, Lanxess officially requested the delay to permit for a more thorough examination of all subsidy programs that could advantage Chinese manufacturers.

The ITA explained that, under US trade law, the agency is usually needed to issue a preliminary determination within 65 days of beginning a countervailing duty probe, except a timely extension request is obtained. Lanxess’s request, targeted at ensuring that “all appropriate subsidy programmes” are properly analyzed , resulted in the deadline being pushed to 130 days after the investigation commenced. The latest target date for the preliminary ruling is October 5.

This extension is restrained to the subsidy investigation and will affect the separate anti-dumping inquiry, which is still anticipated to attain a initial decision via mid-October.

Industry implications: balancing change enforcement and supply chain stability

The decision to expand the review period disclose the challenges regulators face in navigating both trade enforcement and industry supply chain requires.
